Term Limits Amendment

A Resolution to Amend the U.S. Constitution to limit the terms of Representatives and Senators






WHEREAS, The founding fathers never intended election to Congress to be a lifelong position, and,

WHEREAS, It is the will of the people of the State of {state}, it is hereby;

RESOLVED, By two-thirds of the Legislature of the State of {state} here assembled, that the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several states within seven years from the date of its submission by the Congress, or by ratification of three-fourths of the States at a Constitutional Convention of the States, that we also hereby request:

ARTICLE -- 

SECTION 1: No person shall be elected as a Representative or a Senator who has already served eighteen (18) years in either the House of Representative or the Senate, or a combination thereof.

SECTION 2: Immediately after the House of Representatives is assembled in consequence of the first election following ratification of this amendment, they shall be divided as equally as possible into three classes. The seats of the first class shall be vacated at the expiration of the first year, of the second class at the end of the second year, and the third class shall have their terms extended to three years and their seats shall be vacated at the end of the third year, so that one third may be chosen each year. Assignment to each class will be random, except for those states that are only entitled to one Representative shall have their seat assigned to the second class, and states that are only entitled to two Representatives shall have one seat assigned to the second class and one to the third class. The President of the Senate and the Speaker of the House shall confer and determine the random method to be used in this process. Once a seat in the House of Representatives is assigned to a class, it shall remain in that class in perpetuity. If additional seats are added to the House of Representatives, they shall be apportioned to the classes, such that the number of seats in each class remains as equal as possible.

SECTION 3: Any member of the House of Representatives that, at the time of ratification of this amendment, shall already have attained 18 years of service, or will attain 18 years of service at the end of their current term, shall be eligible to seek re-election by the state that elected them for their most recent term for three additional terms.

SECTION 4: Any member of the Senate that, at the time of ratification of this amendment, shall already have attained 18 years of service, or will attain 18 years of service at the end of their current term, shall be eligible to seek re-election by the state that elected them for their most recent term for one additional term.
